License Agreement



IMPORTANT: Read before using this software! This is a legal contract between you (the user) and us (RM Associates) governing your use of this Windows Software, including the packaging, software, and data on it (together the "Dictionary").

The Dictionary is licensed to you. Use of it means that you agree to these license terms. Before using it you should carefully read this License Agreement. If you do not agree with these conditions, simply uninstall the windows program and request a refund.

  1. RM Associates is a trade name and trademark of Robert McNelly. The Dictionary is copyright Kenneth Katzner, all rights reserved. Copying the Dictionary or any part to a mass storage device is expressly forbidden except by using the installation program supplied with the Dictionary in its normal fashion without modification.
  2. We grant you the right to use one copy of the Dictionary on a single-user computer, whether stand-alone or on a network. Simultaneous multiple-user access to the Dictionary is forbidden. You may not sublicense, rent, or lease the Dictionary. You may transfer your license to another single user by delivering the Windows Software and this booklet to that user, but in no other way. Such transfer terminates your license to use the Programs. The recipient must agree to accept the terms of this License Agreement, and then may use the Dictionary subject to the terms of this License Agreement.
  3. You may not decompile, disassemble, change, modify, reverse engineer, decrypt, copy, transfer, or otherwise use the Dictionary except as stated in this License Agreement. You may not use the Programs in conjunction with any other programs intended to permit use of the Dictionary on this Windows Software by more than one user at a time. Copying of particular definitions in the Dictionary incidental to the normal use of a dictionary is permitted for non-commercial use, provided that a substantial portion is not copied.

Limited Warranty/Limitation of Remedies

RM Associates warrants this Windows Software on which the Dictionary is recorded to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of purchase as evidenced by a copy of the original receipt of payment. RM Associates's entire liability and your exclusive remedy will be replacement of any Windows Software that does not meet this limited warranty and is returned to us with a copy of the original receipt of payment. RM Associates will have no responsibility to replace a disk damaged by accident or abuse. Under no circumstances will RM Associates have liability for any incidental, consequential or special damages, including any damages which result from deletion of files, errors, defects, or failure of performance of any computer hardware or software. Some jurisdictions do not allow the limitation of liability for special or consequential damages, so the above limitation may not apply to you.

USE OF THE DICTIONARY IS AT YOUR SOLE RISK

THE DICTIONARY IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND EXCEPT AS PROVIDED IN THE LIMITED WARRANTY ABOVE. RM Associates EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. SHOULD ANY OF THE SOFTWARE IN THE DICTIONARY BE DEFECTIVE, YOU (AND NOT RM Associates) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIRS, OR CORRECTIONS. RM Associates DOES NOT WARRANT THAT THE DICTIONARY WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE DICTIONARY WILL BE ERROR-FREE OR THAT DEFECTS OR ERRORS IN THE DICTIONARY WILL BE CORRECTED. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF IMPLIED WARRANTIES, SO THAT EXCLUSION MAY NOT APPLY TO YOU.

This limited warranty gives you specific legal rights. Some jurisdictions provide other rights or do not permit exclusion or limitation of liability for incidental or consequential damages. As a result, some of the limitations or exclusions may not apply to you. Some jurisdictions have statutory consumer protection provisions which may supersede this section of the Agreement.

GENERAL

If any provision of this Agreement shall be found unlawful, void, or unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining portions of this Agreement. This Agreement is governed by the laws of the Commonwealth of Virginia, USA.
